User Agreement

IMPORTANT: PLEASE READ CAREFULLY BEFORE ACCESSING OR USING The Global Institute of Children’s Mental Health, LLC PROPRIETARY MATERIALS, INCLUDING ANY AUDIO AND/OR VISUAL PRESENTATIONS, MEMBERS AREA, AND/OR PROGRAMS ASSOCIATED WITH The Global Institute of Children’s Mental Health, LLC. 

BY ACCESSING OR USING THE PROGRAM(S), YOU ACKNOWLEDGE THAT:

1. YOU HAVE READ THIS AGREEMENT,
2. YOU UNDERSTAND IT, AND
3. YOU ACCEPT AND AGREE TO BE BOUND BY ITS TERMS.

IF YOU DO NOT AGREE, DO NOT UNDERSTAND, OR DO NOT ACCEPT THIS AGREEMENT, PLEASE DO NOT ACCESS OR USE ANY OF The Global Institute of Children’s Mental Health, LLC’S PROPRIETARY MATERIALS, INCLUDING ANY AUDIO AND/OR VISUAL PRESENTATIONS, MEMBERS’ AREA, AND/OR PROGRAMS ASSOCIATED WITH The Global Institute of Children’s Mental Health, LLC, AND CONTACT US IMMEDIATELY AT prioritysupport@childrensmental.com

This Agreement (“Agreement”) is a legal contract between The Global Institute of Children’s Mental Health, LLC/Global Wellness, LLC., located at 898 Ethan Allen Hwy Suite 6 Ridgefield, CT, United States, 06877

By purchasing a book, course or program, or use The Global Institute of Children’s Mental Health, LLC for training or consultational purposes, you agree to the following terms and conditions:

(Collectively, the “PARTIES”).

WHEREAS,The Global Institute of Children’s Mental Health, LLC  is engaged in the business of education, training, publishing and coaching.

WHEREAS, YOU desire to engage The Global Institute of Children’s Mental Health, LLC  to provide wellness education and professional training to YOU in the form of books, webinars, Audio and/or Visual Presentations, email or other written communication, group phone calls, and/or periodic personal coaching and evaluation.

NOW, THEREFORE, the Parties agree as follows:

SECTION 1: Membership and Program Fees

1.1  Programs:  Under the terms of this Agreement,The Global Institute of Children’s Mental Health, LLC  to provide wellness education and professional training to YOU in the form of books, webinars, Audio and/or Visual Presentations, email or other written communication, group phone calls, and/or periodic personal coaching and evaluation .(“Program(s)”) in exchange for a Course or Program Fee. Course and Program Fees will be determined according to paragraph 1.2. below. Your access to such Programs is made conditional upon payment of the Course or Program Fee.

1.2. Term: The Term of this Agreement will commence upon YOUR acceptance of this Agreement and payment of the applicable Course and Program Fee. Customer hereby agrees that throughout the term of this Agreement, the total cost and the payment terms for the Program are set forth in the Order Form, which shall be attached hereto and made a part hereof. YOU agree and understand that upon commencement of the Term of this Agreement, you will become enrolled in the course or program.

1.3. Termination:The Global Institute of Children’s Mental Health, LLC  may terminate this Agreement at any time in its discretion upon notice to YOU. Paragraphs 3.1. through 3.3. below shall survive termination of this Agreement, binding PARTIES to Confidentiality in perpetuity.

2. Program Fees: By accepting the terms of this Agreement, YOU agree and understand that you are committing to payThe Global Institute of Children’s Mental Health, LLC  for use of the course or program you signed up for.

3. Promotional Material: By accepting the terms of this Agreement and affirmatively seeking the benefits of membership in the Program(s) offered by The Global Institute of Children’s Mental Health, LLC , YOU affirmatively agree and acknowledge that The Global Institute of Children’s Mental Health, LLC may at any time reproduce and/or disseminate any testimonial(s) describing or otherwise referencing, either directly or indirectly. YOUR experience participating in such Program(s), including any specific results experienced by YOU over the course of such participation. YOU agree and acknowledge that this includes any written statements you may publish to social media accounts and online forums related to such course(s) and Program(s). You further represent that any such statements or testimonials that you make shall be correct, accurate, and truthful.

4.  Refunds: The Global Institute of Children’s Mental Health, LLC  will issue a refund within 30 days after the purchase or a course or program with full participation and completion of all quizzes and our tests. These materials must be turned in and a written request must be made. No refunds will be issued without completion of course or program quizzes, tests, or written materials. YOU further acknowledge that in accepting the terms of this Agreement and affirmatively seeking the benefits of and membership in such Program(s), YOU are taking full responsibility for YOUR OWN success. There will be no refunds for any books or literature. 

SECTION 2: NO WARRANTIES

1. Success not Guaranteed: By accepting the terms of this Agreement, YOU agree and understand that The Global Institute of Children’s Mental Health, LLC  provides Program(s) related to wellness education and professional training only and guarantees no specific results. YOU take full responsibility for YOUR own success. Further, you acknowledge that everyone’s success is different, and dependent on factors such as your own drive , dedication, and motivation. Any examples of outcomes or testimonials are not meant as a promise or guarantee of your own outcomes or success. Please be aware that you may experience loss by using the Program. In other words: We do not and cannot guarantee results, you are responsible for your own success, and there is an inherent risk that you will not be successful at obtaining or maintaining a pregnancy or any other outcome you seek through this program. Individual outcomes are the result of commitment, habits, physiological factors, psychological factors, and other factors beyond the control of the The Global Institute of Children’s Mental Health, LLC.The Global Institute of Children’s Mental Health, LLC  are committed to your health, well-being, and success, as well as that of your family; and, beyond this, cannot guarantee results. Neither can it be guaranteed that you will be rescheduled or refunded if you miss a consulting service or wish to pause your consulting package without advance notice.

2. Limited Liability: In no event will The Global Institute of Children’s Mental Health, LLC  be liable to YOU or any party related to you for any damages, including damages or  loss of any kind, whether under a theory of contract, warranty, tort (including negligence) products, liability, or otherwise, even if The Global Institute of Children’s Mental Health, LLC  have been advised of the possibility of such damages. Limitations herein described shall be applied to the greatest extent enforceable under applicable law.

3. Commitment to the course or Program. By accepting the terms of this Agreement, YOU commit and agree to faithfully execute all of the lessons, assignments, and course work in the Program(s) to the best of your ability.

SECTION 3: Confidentiality

1. Client Confidentiality & Testimonials: YOUR participation is 100% confidential. Exceptions to this statement are only as required by law, as in the case of imminent danger to you or to someone else. Testimonials are welcome and deeply appreciated. Your name will be changed on any testimonials you provide in order to protect your privacy. 

2. The Global Institute of Children’s Mental Health, LLC  Confidentiality: Only authorized users, who have duly obtained access to any Programs offered by The Global Institute of Children’s Mental Health, LLC  by personally agreeing to the terms of this Agreement are permitted use and participate with such Programs. Except as expressly authorized by this Agreement, YOU shall not provide or make available any Documentation, Video, Audio, or any login member credentials to any third party, or use the Documentation, Video, Audio, or any login member credentials to teach any third party, or otherwise disclose or discuss information revealed in any portion of the Program(s) for any purpose other than exercising rights expressly granted to you by this Agreement.

3. Intellectual Property: YOU acknowledge that any Audio and/or Visual Presentations, Documentation, and other elements of the Webinar System are the sole Intellectual Property of The Global Institute of Children’s Mental Health, LLC under United States copyright, trademark and other intellectual property laws and international treaties. YOU further acknowledge and agree that, as between YOU and The Global Institute of Children’s Mental Health, LLC , and its third party licensors own and shall continue to own all right, title, and interest in and to the Audio and/or Visual Presentations, Documentation, and other elements of the Webinar System, including associated intellectual property rights under copyright, trade secret, patent, or trademark laws. Except for the limited, revocable license expressly granted to you herein, this Agreement does not grant you any ownership or other right or interest in or to the Audio and/or Visual Presentations, Documentation, and other elements of the Webinar System, or any other intellectual property rights of The Global Institute of Children’s Mental Health, LLC whether by implication, estoppel, or otherwise. Any and all trademarks or service marks that The Global Institute of Children’s Mental Health, LLC uses in connection with services rendered by The Global Institute of Children’s Mental Health, LLC are marks owned by The Global Institute of Children’s Mental Health, LLC. This Agreement does not grant you any right, license, or interest in such marks, and you shall not assert any right, license, or interest in such marks or any words or designs that are confusingly similar to such marks.

SECTION 4: Coaching and Consulting Parameters

1. Dr. Roseann Capanna-Hodge, while maintaining a Ed.D. doctorate degree, is not a medical doctor or physician (M.D.). Please consult your healthcare provider before adopting any content, opinion, suggestion, guidance, idea or recommendation of The Global Institute of Children’s Mental Health, LLC. Such opinion, suggestion, guidance, idea or recommendation are based on scientific or other research spanning multiple disciplines, including psychology and integrative medicine.  As such, any opinion, suggestion, guidance, idea or recommendation of The Global Institute of Children’s Mental Health, LLC is intended to be used in conjunction with, not as a replacement for, advice from qualified medical, legal, accounting, psychological, or other professionals.

2.The Global Institute of Children’s Mental Health, LLC is not a tool for diagnosis or self-diagnosis, nor is it a substitute for proper medical advice, diagnosis or treatment. Proper treatment of physical and/or mental health conditions depends on a number of factors, such as your medical history, diet, lifestyle and the medication that you currently take. Your doctor or other licensed healthcare provider is in the best position to take these and other factors into account in assessing and addressing your individual healthcare needs. Individual results are dependent upon commitment, follow-through, and numerous other variables; and, therefore, cannot reasonably be guaranteed. Your use of the information provided herein is express and implied acceptance and acknowledgement of this advisement and materials of The Global Institute of Children’s Mental Health, LLC under copyright, trade secret, patent, or trademark laws. 

3. Your purchase or use of this publication does not establish a relationship of any kind with The Global Institute of Children’s Mental Health, LLC, including, but not limited to a doctor/physician–patient relationship, a therapist-client relationship, and/or a business relationship.

4. The Global Institute of Children’s Mental Health, LLC and its owners, officers, members, agents and representatives are not responsible or liable for any claim, loss or damage directly or indirectly resulting from any opinion, suggestion, guidance, idea or recommendation contained in this publication or your or your family’s use and acceptance thereof, and you and your family’s use are subject to the disclaimers and limitations set forth herein.

5. The Global Institute of Children’s Mental Health, LLC may recommend products. Product formulations can change at any time. Please ensure that products are safe, including for your situation. Your healthcare provider should be notified, and confirm safety for you, before you begin any supplement, regimen, or use of any other product.

6. The Global Institute of Children’s Mental Health, LLC may contain affiliate links for products that The Global Institute of Children’s Mental Health, LLC  believes in and uses in her work with and for women. Notwithstanding such recommendations and use of affiliate links and products, to which The Global Institute of Children’s Mental Health, LLC  receives, at no added cost to the consumer, a referral fee, The Global Institute of Children’s Mental Health, LLC  makes no promise, representation, warranty or guaranty of any nature or kind as to such affiliate links and products and is not responsible for any damage or injury which may be caused in any way through the use of any such affiliate program or product. You are free not to accept the recommendation of The Global Institute of Children’s Mental Health, LLC and not use an affiliate program or product and in doing so, you are making your own independent choice of your own will.

SECTION 5: Miscellaneous

1. Non-transferability: The rights and obligations under this Agreement are personal to YOU. YOU may not assign or transfer any rights or obligations under this Agreement.

2. Indemnification: YOU will, at your own expense, defend, indemnify, and hold The Global Institute of Children’s Mental Health, LLC , its agents, and employees harmless from any and all claims, actions, liabilities, injuries, damages, losses, grants, costs, and expenses, including attorney fees, arising out of or in connection with any use of the Program(s) of this Agreement.

3. Integration: This Agreement, along with any additional terms or policies incorporated herein by reference, represents the entire Agreement between YOU and The Global Institute of Children’s Mental Health, LLC  concerning the course(s) and Program(s), and this Agreement supersedes and replaces any prior proposal, representation, or understanding YOU may have had with The Global Institute of Children’s Mental Health, LLC  relating to the Program(s), whether oral or written.

4. Amendment: The Global Institute of Children’s Mental Health, LLC reserves the right, in its sole discretion, to amend this Agreement from time to time by posting an updated version of the Agreement, Terms of Service, Privacy Policy, Caring Caution and Publication Disclaimer at www.childrensmentalhealth.com

5. Governing Law: This Agreement shall be governed by and interpreted in all respects in accordance with the laws of the United States of America and the State of Connecticut. The venue for any dispute shall be in Fairfield County, Connecticut.

6. Attorneys’ Fees and Legal Expenses. If any proceeding or action shall be brought to recover any amount under this Agreement, or for or on account of any breach of, or to enforce or interpret any of the terms, covenants, or conditions of this Agreement, the prevailing party shall be entitled to recover from the other party, as part of the prevailing party’s costs, reasonable attorneys’ fees, the amount of which shall be fixed by the court, and shall be made a part of any award or judgment rendered.

BY PURCHASING THIS PROGRAM, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO ALL OF THE A FOREMENTIONED TERMS, INCLUDING THOSE RELATED TO PROGRAM FEES, BILLING, REFUND POLICY, AND CONFIDENTIALITY.
